By accessing or using Merry Magic Mail ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access the Service.

The Service is operated by Droidsize Technologies Pvt. Ltd. ("Company," "we," "us," or "our"), located at WeWork Berger One, Sector 16B, Noida, Uttar Pradesh 201301, India.

2. Description of Service

Merry Magic Mail provides an AI-powered platform for creating personalized Santa Claus experiences, including:

• AI-generated personalized letters from Santa
• Live voice conversations with an AI Santa character
• Personalized audio messages from Santa
• Christmas wishlist creation and management
• Physical printed letter delivery (optional paid service)

3. User Eligibility

Our Service is intended for use by adults (18 years or older) on behalf of children. By using this Service, you represent that:

• You are at least 18 years of age
• You have the legal authority to agree to these Terms
• If creating content for a child, you are the parent or legal guardian of that child

Children under 18 should not use this Service directly. Parents/guardians are responsible for supervising their children's interactions with the Service.

4. Account Registration

Some features may require account registration. When registering, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

5. Acceptable Use

You agree NOT to use the Service to:

6. AI-Generated Content

Our Service uses artificial intelligence to generate content. You acknowledge that:

• AI-generated responses are automated and may occasionally produce unexpected results
• We review and filter content for appropriateness, but no system is perfect
• The AI character "Santa Claus" is fictional and for entertainment purposes
• We are not responsible for how children interpret AI-generated content
• Parents should supervise and review all content before sharing with children

7. Payments and Refunds

Pricing: Prices are displayed at checkout and may change without notice. All prices are in USD unless otherwise stated.

Payment Processing: Payments are processed securely through Polar. We do not store your payment card details.

Refund Policy:

• Digital Products: Due to the instant delivery nature of digital content (letters, audio messages), refunds are generally not available once content has been generated and delivered
• Physical Letters: Refunds available within 7 days of purchase if the letter has not been shipped. Once shipped, refunds are not available
• Santa Calls: Non-refundable once the call has been initiated
• Technical Issues: If you experience technical problems preventing you from receiving your purchase, contact support@merrymagicmail.com within 48 hours for a full refund or replacement

8. Intellectual Property

Our Content: The Service, including its design, logos, text, graphics, and software, is owned by Droidsize Technologies Pvt. Ltd. and protected by intellectual property laws.

Your Content: You retain ownership of content you submit (letter requests, wishlist items). By submitting content, you grant us a license to use it to provide the Service.

Generated Content: AI-generated letters and audio messages are licensed to you for personal, non-commercial use. You may share them with family and friends but may not resell or redistribute them commercially.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated content may contain errors or unexpected outputs.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DROIDSIZE TECHNOLOGIES PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Droidsize Technologies Pvt. Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Noida/Delhi, India.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
